Terms of Service
Last updated 1 October 2026. These terms are an agreement between you and JMIT,INC., doing business as WiCare.ai (“WiCare”, “we”, “us”), 255 S Orange Ave, Ste 104 #2457, Orlando, FL 32801, USA. Questions: support@wicare.ai or 1 (833) 962‑5525.
In short. WiCare helps an older adult and the family they choose keep up with medicines, appointments and each other. The person being cared for is in charge of their own information. WiCare is not an emergency service, not a medical device and does not give medical advice. Lilly, our assistant, can make mistakes. Please don’t rely on WiCare alone for anyone’s safety. In an emergency, call 911.
By creating an account, accepting an invitation, or using the WiCare app, family dashboard, website, help line or text messages, you agree to these terms and to our Privacy Policy. If you don’t agree, please don’t use WiCare. Nothing in these terms reduces the protections in our Privacy Policy. If the two ever seem to disagree about your information, the Privacy Policy wins.
1. Who can use WiCare
- You must be 18 or older to create a WiCare account.
- A family member or caregiver may set up WiCare for someone they care for, but only with that person’s agreement, or if they have the legal authority to act for them (for example, a health-care power of attorney or a guardianship). When you set up WiCare for someone else, you are telling us that this is true.
- WiCare is offered in the United States. If you use it somewhere else, you are responsible for following the local law.
2. Accounts and care circles
- The resident. We call the person being cared for the resident (for example, Esther). Their WiCare record holds their medicines, appointments, check-ins and contacts.
- The care circle. The resident can invite family members and caregivers (for example, her daughter Sarah). Each person only sees the areas the resident has shared with them.
- Care organizations. A home-care agency or care community can see a resident’s information only after the resident joins with the organization’s code and picks what to share. An organization can never sign up a resident on its own.
- Shared logins. Sometimes one login is used both by the resident and by the family member who set it up. Anyone who uses that login can see and change what it can. When you can, give each person their own login (you can do this from the dashboard).
- Keep your account safe. Give us true information, keep your password private, and tell us right away at support@wicare.ai if you think someone else is using your account. You are responsible for what happens under your login.
3. The resident is in control
WiCare is built so the resident decides who sees what. Permission is given area by area (for example, medicines, appointments, alerts), and our database enforces it, not just the screen. The resident can change or take back any permission at any time, remove anyone from the care circle, and stop sharing with a care organization. Features that need extra consent, such as connecting health data or letting Lilly use a camera, stay off until the resident agrees, and each can be turned off again. Consent is recorded so it can be reviewed and withdrawn.
If you help someone use WiCare, respect their choices, even when you disagree with them, unless you have the legal authority to decide for them.
4. What WiCare is and is not
WiCare is a tool for daily routines, reminders, keeping track, and family communication.
WiCare is not:
- An emergency service. The help button sends an alert that shows on the family’s WiCare dashboard. Where this is turned on, WiCare may also try to text or call the emergency contacts the resident chose. WiCare does not call 911, does not send anyone, and cannot promise that anyone sees an alert or answers. In an emergency, call 911.
- A medical device, and not medical advice. WiCare does not diagnose, treat, cure or prevent any condition. Reminders, readings, notes and anything Lilly says are for information only. Always follow the advice of a doctor, nurse or pharmacist, and ask them before changing a medicine.
- A replacement for people. WiCare does not replace caregivers, nurses, home health aides, a medical alert service, or professional monitoring. It does not watch anyone around the clock.
Phones run out of battery, internet goes down, and messages can be late or never arrive. Please plan for that.
5. Lilly, the assistant
- Lilly answers questions, reads out the day’s plan, reminds, and helps keep track. Many answers come from simple rules and your own records. Some features may use an outside AI service when they are turned on, as our Privacy Policy explains.
- Lilly can be wrong. She may mishear, misunderstand, or give an answer that is out of date or incomplete. Check anything important, especially about medicines, with a person you trust or a health professional.
- Safety always points to 911. If someone tells Lilly about an emergency, she gives the same fixed reply: call 911 and use the help button. Lilly never decides on her own that there is an emergency, and she cannot call 911.
- Lilly’s check-ins and suggestions are reminders, not instructions. The resident decides what to do.
- When the camera check is available and the resident has turned it on, Lilly can look at a few pictures at medicine time. Pictures can never confirm that a dose was taken. The resident still marks each dose.
6. Lilly’s own phone number and email
When this feature is available, a resident can have their own Lilly phone number and Lilly email address, so family, a doctor’s office or a pharmacy can send messages for them.
- Who can send messages. Anyone who has the number or address can write to it. Lilly tells people outside the resident’s circle only “Thanks. I’ll pass your message on,” and never shares anything about the resident with them. We may limit how many messages a stranger can send.
- Messages may go unseen. Lilly tries to make sure the resident sees a message, and may tell the family when an important one isn’t seen. We can’t promise any message will be read, on time or at all. Don’t use Lilly’s number or email for anything urgent or life-threatening. For an emergency, call 911.
- Appointments found in messages are only drafts. Nothing is added to the calendar until someone confirms it.
- If you give a Lilly number or address to other people, you are responsible for choosing who gets it.
7. Text messages
WiCare’s text messages (reminders, check-ins, alerts and support replies) follow our text message (SMS) terms, including how to opt in, how often messages come, and how to stop them (text STOP) or get help (text HELP). Message and data rates may apply.
8. Connected devices and other services
You can choose to connect WiCare to other services. Some are available now and some are still coming. Examples:
- Health apps such as Apple Health (on iPhone) and Health Connect (on Android), and device accounts such as Withings, for readings like blood pressure, weight or steps.
- Health records such as a patient portal or Medicare’s Blue Button, for medicines, visits and claims.
- Smart-home accounts for things like lights, thermostats, cameras or door sensors.
- Public information from U.S. government sources, such as medicine recalls, medicine information, doctor and pharmacy directories, and weather alerts.
When you connect one of these:
- Their own terms apply. Those services belong to other companies or agencies. Their terms and privacy policies cover what happens on their side, and we are not responsible for them.
- WiCare shows only what they report. Readings, records and device states can be wrong, late, incomplete or missing. WiCare does not check them for accuracy and does not interpret them medically. A missing reading doesn’t mean something is wrong, and a normal-looking one doesn’t mean everything is fine.
- Health data is read-only. WiCare reads from health apps and records. It does not write to them.
- Controlling devices has risks. If you or Lilly use WiCare to change a device (for example, turn off a heater or lock a door), the command may fail, be delayed, or do something you didn’t expect. WiCare asks for confirmation before important actions. Check that the device did what you wanted.
- Never rely on WiCare for safety-critical devices, such as oxygen equipment, medical pumps, stoves, smoke or carbon monoxide alarms, door locks you depend on for safety, or heating and cooling in extreme weather. Use the device’s own controls and alarms.
- You can disconnect any service at any time. Our Privacy Policy explains what we keep and delete.
9. Plans, payments and cancelling
- Plans. The Essential plan is free. The paid Independent and Independent + plans add more features. Current prices and what each plan includes are on our pricing page.
- Free trial. New customers get a 30-day free trial of a paid plan. There is one trial per customer: if you have already bought a WiCare plan before, the trial does not apply. You add a payment card at checkout, but you are not charged during the trial. When the 30 days end, your card is charged for the plan you chose unless you cancel before the trial ends. You can cancel during the trial in the WiCare app (Plan & billing → Manage billing) or by emailing support@wicare.ai.
- Payments. Paid plans are billed through Stripe, our payment processor. We don’t see or store your full card number. Stripe’s own terms apply to the payment.
- Renewal. Paid plans renew automatically, monthly or yearly depending on what you chose, and your payment method is charged at the start of each period until you cancel. Prices are in U.S. dollars. We will tell you at least [30] days before a price change affects your plan.
- Cancelling. You can cancel at any time in the WiCare app (Plan & billing → Manage billing, which opens our payment processor’s secure billing page) or by emailing support@wicare.ai. Your paid features stay on until the end of the period you already paid for, and then your account moves to the free Essential plan.
- Refunds. If you ask within 14 days of a charge, we will refund that charge in full: email support@wicare.ai. After 14 days, charges are not refundable, but cancelling stops the next one. Where the law gives you a right to a refund, we will honor it.
- Promotional codes apply only where stated and can’t be exchanged for cash.
- Taxes. Prices may not include sales tax, which we add where the law requires.
10. Using WiCare fairly
Please don’t:
- use WiCare to watch, track or collect information about anyone without their agreement or legal authority;
- send false help alerts, or use the help line, Lilly’s number or text messages to harass, scare, spam or mislead anyone;
- pretend to be someone else, or use someone else’s account without permission;
- upload anything illegal, harmful or that you don’t have the right to share;
- try to break, overload, copy, reverse-engineer or get around the security of WiCare, or reach data you weren’t given;
- use bots or scripts to access WiCare, or resell it, without our written permission;
- use WiCare in a way that breaks the law.
11. What we ask of families and caregivers
- Only add people to a care circle, or as emergency contacts, if they have agreed to it.
- Enter medicines, doses and appointments carefully and keep them up to date. WiCare reminds based on what is entered.
- “Marked taken” means someone tapped a button. It doesn’t prove a medicine was taken.
- Keep your own plan for emergencies and for days when phones or internet don’t work.
- Respect the resident’s privacy and choices, and use what you see only to help care for them.
12. Your content and your data
- The resident’s information belongs to the resident. You and the resident keep ownership of what you put into WiCare, such as medicines, notes, messages and photos.
- What you allow us to do. You give us permission to store, copy, process and show your content only as needed to run WiCare for you: to deliver it to the people you chose, to provide the features you use, to keep the service safe, and to follow the law. This permission ends when the content is deleted, except for backups that are deleted on a schedule and records the law requires us to keep.
- We don’t sell your information or use health information for advertising. Our Privacy Policy explains exactly how information is used and shared.
- Ideas and feedback. If you send us suggestions, we may use them to improve WiCare without owing you anything. We won’t share your personal information when we do.
- WiCare itself. The WiCare app, website, name, logo and Lilly belong to us or our licensors. We give you a personal, non-transferable right to use WiCare under these terms.
13. Availability and changes to the service
We work to keep WiCare running, but it may sometimes be slow or unavailable, for example during maintenance, outages at our providers, or problems with phones, internet or text-message carriers. Features marked Soon are not available yet. We may add, change or remove features. If we remove something important from a paid plan, we will tell you ahead of time and you may cancel. You can check current status at wicare.ai/status.
14. Disclaimers and limits on liability
WiCare is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don’t promise that WiCare will be uninterrupted or error-free, that any reminder, alert or message will be delivered or seen, or that information from Lilly, connected devices, health records or public sources will be accurate or complete.
To the fullest extent the law allows, WiCare and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, or personal injury or property damage that results from relying on WiCare instead of emergency services, medical professionals or a device’s own controls, however caused and even if we were told they might happen.
To the fullest extent the law allows, our total liability for any claim related to WiCare is limited to the greater of (a) the amount you paid us for WiCare in the 12 months before the claim, or (b) US$100.
Some states don’t allow some of these exclusions or limits, so they may not all apply to you. Nothing in these terms limits liability that cannot be limited by law.
You agree to be responsible for, and to cover our reasonable costs from, claims that arise because you broke these terms or the law, or used WiCare to collect information about someone without their agreement or legal authority.
15. Ending your account and deleting data
- You can stop using WiCare at any time. To close your account and delete your data, email support@wicare.ai from the address on the account. The resident can also ask us to delete their care record.
- Leaving a care circle or being removed from one ends your access to that resident’s information.
- We may suspend or close an account that breaks these terms, puts others at risk, or where the law requires it. When we can, we will tell you first and give you a chance to fix the problem or save your information.
- After an account is closed, we delete or de-identify its data as described in our Privacy Policy.
- The sections on content and data, disclaimers and liability, governing law, and anything else that by its nature should last, continue after your account ends.
16. Governing law and disputes
These terms are governed by the laws of the State of Florida, USA, and applicable U.S. federal law, without regard to conflict-of-law rules. Before filing a claim, please contact us at support@wicare.ai so we can try to solve it together. Any lawsuit about these terms or WiCare will be brought in the state or federal courts located in Osceola County, Florida, unless the law where you live gives you the right to bring it there.
17. Changes to these terms
We may update these terms. We will change the date at the top, and for important changes we will tell you in the app or by email at least [30] days before they take effect. If you keep using WiCare after the changes take effect, you accept the new terms. If you don’t agree, you can cancel and close your account.
